1) Terms of Service

Welcome to Dream Cosmos ("we", "us", "our"). By creating an account or using our services, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the platform.

1. About Dream Cosmos

Dream Cosmos (ABN 38685466189) provides a cloud-based AI chat and knowledge system for Australian businesses. The service allows you ("you", "your") to upload data, create AI agents, and embed them on your own websites.

2. Accounts and Access

• You must be at least 18 years old to register.
• You are responsible for safeguarding your login and for all activity under your account.

3. Subscription Plans & Payments

• We offer free trial access, paid monthly subscriptions, and optional add-on message credit packs.
• Payments are processed securely via PayPal only.
• You can cancel at any time from your dashboard; cancellation stops future recurring charges by cancelling the PayPal billing agreement, but does not refund prior charges except where required under Australian Consumer Law.
• All prices listed are final. Dream Cosmos is not required to register for Goods and Services Tax (GST) under Australian tax law and is therefore not registered. Consequently, GST is not charged, collected, or included in any fees.
• Subscription fees, features, message limits, scraping limits, and credit allocations may change with reasonable notice.
• Message credits, trial credits, complimentary credits, and add-on credits are service-based usage allowances only, are not legal tender, hold no cash value, are non-transferable, and are non-refundable except where required by law.
• Add-on credits may only be used subject to an active qualifying subscription where applicable under the plan structure.

4. Uploaded Content & AI Training

• You may upload CSV files or other materials to train your AI agent.
• You retain ownership of your uploaded content.
• You can delete uploaded content at any time; we will remove it from storage and your agent's knowledge base.
• We do not sell or share your uploaded content with third parties.
• Important: Your uploaded content becomes a knowledge source that your AI agent uses to answer questions on your website's chat. We do not publish or display your raw files or list their contents; responses are generated, not verbatim reproductions.

4A. Website Import, Scraping & External Content Responsibility

• If you submit website URLs, domains, or external content sources to Dream Cosmos for scraping, import, or AI knowledge generation, you represent and warrant that you own, control, or otherwise have lawful authority to access and use that content for such purposes.
• You are solely responsible for ensuring that your use of website import, scraping, or content ingestion complies with applicable copyright, privacy, contractual, and data access laws.
• Dream Cosmos does not independently verify ownership or usage rights for submitted URLs or imported content.
• Dream Cosmos is not liable for customer misuse of scraping tools, unlawful imports, or third-party claims arising from content you choose to import or process.

5. AI‑Generated Responses

Our AI agents generate responses automatically based on your uploaded data and general model behaviour. While we aim for accuracy, all AI systems can produce incomplete or incorrect information. By using Dream Cosmos, you acknowledge that:

• AI responses are automatically generated and are not manually reviewed, approved, or guaranteed by Dream Cosmos;
• AI systems may produce inaccurate, incomplete, outdated, misleading, or inappropriate responses despite reasonable safeguards;
• You are solely responsible for reviewing, testing, supervising, and approving how your AI agent is configured and what information it provides to your customers or users;
• Dream Cosmos does not guarantee uninterrupted accuracy, suitability, merchantability, or fitness for any specific business purpose;
• To the maximum extent permitted by law, Dream Cosmos is not liable for business losses, lost profits, reputational harm, customer disputes, or other damages arising from reliance on AI-generated outputs.

6. Fair & Acceptable Use

• Do not upload unlawful, harmful, infringing, or offensive content.
• Do not attempt to disrupt, misuse, or reverse‑engineer the platform.

6A. Third-Party Providers, Infrastructure & Service Availability

• Dream Cosmos may rely on third-party providers including but not limited to cloud hosting providers, artificial intelligence providers, payment processors, analytics tools, and infrastructure services.
• Service availability may depend partly on these third-party providers. While we take reasonable steps to maintain platform reliability, we do not guarantee uninterrupted availability, uptime, error-free operation, or continuous access.
• Dream Cosmos is not responsible for outages, delays, interruptions, or failures caused wholly or partly by third-party services beyond our reasonable control.
• We may perform maintenance, upgrades, security changes, or service modifications from time to time.

7. Suspension & Termination

We may suspend, restrict, or terminate access immediately where reasonably necessary for security, payment default, suspected fraud, unlawful activity, abusive conduct, excessive misuse, breach of these Terms, or protection of Dream Cosmos, other users, or third parties. You may close your account at any time, subject to any outstanding lawful payment obligations.

8. Liability & Australian Consumer Law

To the maximum extent permitted by law, including subject to the Australian Consumer Law (ACL), Dream Cosmos excludes liability for indirect, incidental, special, exemplary, consequential, or loss-of-profit damages. Where liability cannot be excluded, our total aggregate liability for any claim relating to the service is limited, to the extent permitted by law, to the amount paid by you to Dream Cosmos for the service in the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes, restricts, or modifies rights that cannot lawfully be excluded under Australian law.

9. Governing Law

These Terms are governed by the laws of Australia. Disputes are subject to Australian courts.

2) Privacy Policy

We respect your privacy and comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. Information We Collect

• Account details (name, email, password).
• Files/data you upload to train your AI agent.
• Usage data (e.g., message counts, basic analytics).
• We do not collect your card details, payments are handled by PayPal.

2. How We Use Information

• To provide and maintain your AI agent and dashboard analytics.
• To improve reliability, security, and support.
• We do not sell your personal data. We may use carefully selected third-party service providers (such as hosting, AI, infrastructure, analytics, and payment providers) where reasonably necessary to operate, secure, and improve the service.

3. Storage, Security & Deletion

• Your data is stored using reputable cloud and technology providers, which may include Australia and trusted international jurisdictions, subject to reasonable security safeguards and operational requirements.
• You can delete uploaded content at any time; deletion removes it from storage and from your agent's knowledge base.

4. AI Responses & Content Exposure

• Your uploaded content informs answers your AI agent gives to visitors on your site.
• We do not publish or list your raw files; responses are generated, not direct replicas of your content.

5. Cookies & Analytics

• We may use cookies for login and usage metrics. You can disable cookies in your browser, though some features may not work.

6. Access & Correction

• Access, export, or delete your information via your dashboard or by emailing contact@dream-cosmos.com.

7. Complaints

If you have privacy concerns, contact us first. If unresolved, you may contact the Office of the Australian Information Commissioner (OAIC) for assistance.

3) Refund & Cancellation Policy

• Cancel your subscription anytime from your Dream Cosmos dashboard; this cancels the PayPal billing agreement and stops future charges.
• We do not generally offer refunds for partial, unused, or change-of-mind subscription periods, except where required under Australian Consumer Law.
• A free trial is available for testing before subscribing.
• For billing issues or errors, email contact@dream-cosmos.com and we'll investigate promptly.

4) Disclaimer

The Dream Cosmos service provides automated AI-generated responses based on uploaded, imported, configured, and processed information. AI outputs may be inaccurate, incomplete, inconsistent, or unsuitable for specific circumstances. You are responsible for independently reviewing, testing, and validating outputs before relying on them commercially, legally, operationally, or otherwise. Dream Cosmos provides the platform on an "as available" basis, subject to applicable law.

To the extent permitted by law, Dream Cosmos is not responsible for any loss, damage, or liability arising from AI-generated content or user-provided data. Nothing here limits your rights under the Australian Consumer Law.
